Terms of use

The terms on which you may use HealOS Patient. Section 2 matters most — please read it.

1. This agreement

These terms are an agreement between you and DORM Limited (“we”, “us”), the operator of HealOS Patient. By creating an account or using the app, you accept them. If you do not accept them, please do not use the app.

They should be read together with our privacy policy, which explains how we handle your information.

2. What this app is not

HealOS Patient does not provide medical care, diagnosis or treatment advice, and it is not an emergency service.

If you believe you are having a medical emergency, call your local emergency number or go to the nearest emergency department. Do not wait for a response in this app.

The app displays information recorded by licensed clinicians at the hospital treating you, and lets you record readings of your own. It is a window onto your record and a channel to your care team. Clinical decisions remain the responsibility of your clinicians.

The Emergency feature shows nearby hospitals and reported bed availability supplied by those hospitals. That information can be out of date. Always call ahead before travelling, and never rely on the app alone in an urgent situation.

3. Who can use it

  • You must be 16 or older to hold an account in your own name.
  • A parent or legal guardian may hold an account on behalf of a child in their care, and is responsible for everything done through it.
  • The app is intended for patients of hospitals that use the HealOS platform. Without a linked hospital record, most features will have nothing to show.

4. Your account

  • Give accurate registration details, and keep them current. Clinical staff may rely on them.
  • Your account is personal to you. Do not share your password, and do not let anyone else sign in as you.
  • Keep your device secure. Where you enable a passkey, anyone who can unlock your device with Face ID or Touch ID can open your record.
  • Tell us promptly at greatattai442@gmail.com if you think someone else has accessed your account.

5. Your medical record

The clinical content of your record is created and controlled by the hospital treating you, not by us. We display it; we do not author it and we may not alter it.

  • If something in your record looks wrong, raise it with your hospital’s medical records department. We cannot correct a clinical entry on your request alone.
  • Readings you enter yourself are shown to clinicians as patient-reported, and are not a substitute for a clinical measurement.
  • A share link grants whoever holds it read access to your record for one hour. Only send one to a person you intend to give that access.

6. Acceptable use

You agree not to:

  • access, or try to access, any record that is not your own or one you are the guardian of;
  • interfere with, probe or attempt to breach the security of the service;
  • copy, scrape or redistribute another person’s health information;
  • upload material that is unlawful, or that infringes someone else’s rights;
  • impersonate anyone, including clinical staff;
  • use the app to harass a clinician or another patient;
  • reverse engineer the app, except to the extent the law expressly permits.

7. Wallet and payments

  • The hospital wallet holds a balance you can put toward care at hospitals on the HealOS platform. It is not a bank account, it earns no interest, and it is not a deposit-taking service.
  • Top-ups are processed by Paystack. Your card details are handled by Paystack under their terms; we do not receive or store them.
  • Charges against your balance are raised by your hospital according to its own pricing. Query any charge with the hospital that raised it.
  • Refunds of a wallet balance are handled by the hospital holding it, subject to its refund policy and applicable law.

8. The AI assistant

The in-app assistant explains information already present in your record. Its answers are generated automatically and may be incomplete or wrong.

  • Do not rely on it for diagnosis, dosage, or any clinical decision.
  • Do not use it in an emergency.
  • Using it sends the relevant part of your record to a third-party model provider, as described in our privacy policy. If you would rather that did not happen, do not use the feature.

9. Availability

We aim to keep the service running, but we do not guarantee it will be uninterrupted or error-free. We may suspend it for maintenance, and we may change or withdraw features. Where a change is significant and we can reasonably give notice, we will.

10. Our intellectual property

The app, this website, the HealOS name and the software behind them belong to DORM Limited and its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own health care. Nothing here transfers ownership to you.

Your health information remains yours and your hospital’s. Our licence to handle it is limited to what the privacy policy describes.

11. Suspension and closure

You may close your account at any time — see deleting your account.

We may suspend or close an account that breaches these terms, that we reasonably believe is being used to access someone else’s record, or where we are required to by law. Where we can do so safely and lawfully, we will tell you why.

Closing your app account does not delete the clinical record your hospital is required to retain.

12. Liability

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, and to the extent the law allows:

  • we are not liable for clinical decisions, treatment, or the accuracy of clinical content authored by your hospital;
  • we are not liable for bed availability, waiting times or other operational information reported by a hospital;
  • we are not liable for indirect or consequential loss, or for loss of profit, revenue or data;
  • we provide the app “as is”, and give no warranty that it will meet a particular clinical need.

13. Apple App Store terms

Where you download the app from the Apple App Store:

  • this agreement is between you and DORM Limited only, not with Apple, and we alone are responsible for the app and its content;
  • your use is also subject to the App Store Terms of Service and Apple’s Licensed Application End User Licence Agreement, and where those conflict with these terms in relation to the App Store, they prevail;
  • Apple has no obligation to provide support or maintenance for the app;
  • if the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; beyond that, Apple has no warranty obligation;
  • Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory or intellectual property claims;
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Nigeria have jurisdiction over any dispute. If you are a consumer in another country, you keep the benefit of any mandatory protections of your local law.

15. Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed. Where a change materially affects your rights, we will tell you in the app before it takes effect. Continuing to use the app after that means you accept the updated terms.
